Agreement to Terms

By accessing or using TryDrobe ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

TryDrobe is an AI-powered virtual try-on platform that allows users to visualize how clothing items look on themselves by uploading photos. The Service uses artificial intelligence to generate realistic preview images.

Age Requirement and Eligibility

You must be at least 18 years old to use TryDrobe. By creating an account, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will provide accurate date of birth information when required

We verify age during account creation. If we discover that you are under 18, we will immediately terminate your account and delete all associated data without refund.

Account Registration

To use certain features of the Service, you must register for an account. You may register using:

• Email and Password: Create an account directly with us
• OAuth Providers: Sign in with Google (we receive your email and name only)

By registering, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Not share your account credentials with others

Subscription Plans and Billing

TryDrobe offers subscription plans with different features and limits:

All subscriptions are processed through Stripe and automatically renew unless cancelled. You may cancel at any time through the Stripe Customer Portal (accessible from your billing page). Credits do not carry over between billing periods and reset to your plan amount each month.

Billing is handled securely by Stripe. We do not store your payment card details.

Credits and Usage

Each try-on costs 2 credits. Credits reset monthly on your billing date and do not carry overbetween billing periods. Unused credits expire at the end of each billing cycle.

Why Credits Don't Carry Over: Our subscription model is based on monthly capacity rather than cumulative usage. This pricing structure reflects the varying and unpredictable costs of third-party AI services (such as Google Gemini API) that fluctuate month-to-month based on demand, processing requirements, and provider pricing changes. Monthly credit resets allow us to maintain sustainable and predictable pricing for all users while managing these variable operational costs.

Storage Limits: Each plan has limits on stored model photos and garments. You must delete old items to upload new ones if you reach your limit. Try-on results are automatically deleted after the retention period for your plan (30, 90, or 365 days depending on your tier).

Processing Priority: Pro and Premium plans receive priority processing, meaning your try-on jobs are processed ahead of Basic plan users during high-traffic periods.

Acceptable Use and Content Policy

You agree NOT to:

• Upload images of minors or other individuals without consent
• Upload inappropriate, offensive, sexually explicit, or illegal content (NSFW)
• Use the Service for any unlawful purpose
• Attempt to reverse engineer or copy our AI technology
• Abuse, harass, or harm others
• Violate any applicable laws or regulations
• Upload malware, viruses, or harmful code
• Scrape, crawl, or use automated tools to access the Service
• Resell or redistribute our services without permission

Content Moderation: We employ automated NSFW (Not Safe For Work) filtering to detect and block inappropriate content. Uploaded images are screened for explicit, sexual, or otherwise inappropriate content before processing. Users who repeatedly attempt to upload inappropriate content will have their accounts terminated without refund.

Content Ownership and Rights

You retain all rights to images you upload. By uploading content, you grant TryDrobe a limited license to process, store, and display your images solely for providing the Service. We do not claim ownership of your content.

Generated try-on images are provided for your personal use. All intellectual property rights in our Service, including our AI technology, remain with TryDrobe.

Third-Party Services and Data Processing

TryDrobe relies on several trusted third-party services to deliver our platform:

• Google Gemini API: Processes your uploaded images to generate virtual try-on results. Google does not use your images to train their models.
• Stripe: Handles all payment processing and subscription management. We do not store your payment card details.
• Supabase: Provides our database, authentication, and secure image storage infrastructure.
• Vercel: Hosts our application and provides content delivery.
• PostHog: Provides analytics to help us improve the Service.
• TikTok Pixel: Tracks conversion events (registrations and purchases) for advertising measurement.

By using TryDrobe, you acknowledge and agree that:

• Your images will be processed by Google's Gemini API to generate try-on results
• Your data may be processed by the third-party services listed above as necessary to provide the Service
• You are responsible for ensuring you have the right to upload and process all images you submit
• You must comply with both TryDrobe's Terms and the terms of our third-party service providers

AI-Generated Content Disclaimer

Virtual try-on results are AI-generated approximations and may not be 100% accurate. Colors, fit, and appearance may vary from actual products. We do not guarantee perfect accuracy and are not responsible for purchasing decisions based on try-on results.

Refund Policy

TryDrobe operates a strict no-refund policy. All subscription fees are charged in advance and are non-refundable. This includes:

• Monthly subscription charges
• Unused credits at the time of cancellation
• Partial months of service
• Subscription renewals

If you cancel your subscription, you will retain access to your plan and remaining credits until the end of your current billing period. No refunds will be provided for the remaining time or unused credits.

In rare and exceptional circumstances (such as technical errors, billing mistakes, or extraordinary situations), we may consider refund requests on a case-by-case basis at our sole discretion. Such exceptions are not guaranteed and should not be expected.

Account Termination and Deletion

Termination by Us: We reserve the right to suspend or terminate your account at any time for violations of these Terms, including but not limited to abuse of the Service, fraudulent activity, inappropriate content uploads, or age misrepresentation. Upon termination, your right to use the Service will immediately cease.

Termination by You: You may delete your account at any time through your account settings or by contacting us. Upon account deletion:

• Your account and profile data will be permanently deleted
• All uploaded images and try-on results will be permanently deleted
• Your subscription will be cancelled (no refund for unused time)
• All remaining credits will be forfeited

Active Subscriptions: If you have an active Stripe subscription, it may continue to charge you until you cancel it through the Stripe Customer Portal. Please cancel your subscription before deleting your account to avoid future charges. We will attempt to reconnect your subscription to a new account if you re-register with the same email address.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRYDROBE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Indemnification

You agree to indemnify and hold TryDrobe harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another person or entity.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.
